Terms of Service

Subject to your compliance with this EULA, Filin Solutions FZE grants you a limited, non-exclusive, non-transferable, revocable license to use the Mentat Ai App for your personal, non-commercial use on compatible devices that you own or control. This license does not grant you any rights to modify, distribute, sell, or sublicense the App or any of its components.

You must be at least 18 years old to download or use the App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this EULA. If you do not meet these requirements, you must not use the App.

You shall not:

• Use the App in any way that violates applicable laws, regulations, or third-party rights.
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App.
• Remove or modify any copyright, trademark, or other proprietary notices contained in the App.
• Use the App for any unlawful, harmful, or offensive purpose, or in any manner that could damage, disable, or impair the App's functionality.

Mentat is a well-being companion designed to support self-reflection and emotional well-being. It is not a medical device and does not provide medical, psychological, psychiatric, or other professional health advice, diagnosis, or treatment. Mentat is not a substitute for professional care from a qualified healthcare provider, and it is not a licensed therapist.

The App and its AI-generated responses are provided for general support and informational purposes only. Never disregard or delay seeking professional advice because of something you read or received in the App, and always consult a qualified professional about any medical or mental-health condition.

Mentat is not an emergency service and cannot help in a crisis. If you are in crisis, thinking about harming yourself or others, or facing a medical emergency, contact your local emergency services immediately or a crisis hotline in your area.

The App may let you create content such as messages, notes, and entries ("Your Content"). As between you and Filin Solutions FZE, you retain all rights in Your Content. You grant us a limited, worldwide, non-exclusive license to host, store, process, and transmit Your Content solely to operate and provide the Service to you - including sending it to our third-party AI providers to generate responses - and as described in our Privacy Policy. You are responsible for Your Content and represent that you have the right to submit it.

Some features of the App may require a paid subscription. Subscriptions are sold and processed through the Apple App Store or Google Play and are billed to the account you use with that store, subject to that store's terms.

Subscriptions renew automatically. Unless you cancel at least 24 hours before the end of the current period, your subscription will automatically renew and your store account will be charged the applicable price for the next period. Prices may vary by region and are shown to you before you purchase.

You can manage or cancel your subscription at any time in your Apple App Store or Google Play account settings. Deleting the App does not cancel your subscription. Except where required by law or by the applicable store's policies, payments are non-refundable, and refunds are handled by the store. If we offer a free trial, any unused portion of the trial is forfeited when you purchase a subscription, where applicable.

The Mentat Ai App and all its intellectual property rights, including but not limited to copyrights, trademarks, and trade secrets, are the property of Filin Solutions FZE. This EULA does not transfer any ownership rights to you, and all rights not expressly granted in this agreement are reserved by Filin Solutions FZE.

Your use of the App is subject to our Privacy Policy, which is incorporated by reference into this EULA. Please review the Privacy Policy to understand how we collect, use, store, and protect your personal information, including how long we keep it and how you can request its deletion.

Filin Solutions FZE may provide updates, enhancements, or bug fixes to the App at its sole discretion. This EULA applies to any updates or modifications to the App, unless such updates are accompanied by a separate license agreement. We may also offer customer support for the App, but we are not obligated to do so.

This EULA is effective until terminated. Filin Solutions FZE may terminate this license at any time if you fail to comply with its terms. Upon termination, you must uninstall the App and destroy all copies in your possession. You may stop using the App and request deletion of your account and data at any time, as described in our Privacy Policy.

The Mentat Ai App is provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express or implied, regarding performance, accuracy, reliability, availability, or fitness for a particular purpose. Your use of the App is at your own risk, and Filin Solutions FZE shall not be liable for any damages arising from your use.

To the extent permitted by law, Filin Solutions FZE shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or related to the use or inability to use the App.

To the maximum extent permitted by law, you agree to indemnify and hold harmless Filin Solutions FZE and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your misuse of the App or your violation of this EULA or applicable law.

If you have a concern or dispute, please contact us first at contact.mentat.ai@gmail.com so we can try to resolve it informally. Most concerns can be resolved this way.

This EULA shall be governed by and construed in accordance with the laws of the United Arab Emirates, excluding its conflict of laws principles. Any disputes arising out of this EULA shall be subject to the exclusive jurisdiction of the courts in the United Arab Emirates. Nothing in this section deprives you of the protection of any mandatory consumer-protection laws of the country in which you live.

The following additional terms apply if you download the App from the Apple App Store. This EULA is concluded between you and Filin Solutions FZE only, and not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App, including product-liability, legal, regulatory, or consumer-protection claims, or claims that the App infringes a third party's rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government list of prohibited or restricted parties. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this EULA and, upon your acceptance, will have the right to enforce it against you.

If you download the App from Google Play, you acknowledge that this EULA is between you and Filin Solutions FZE only, and not with Google, and that your use of the App must also comply with the then-current Google Play Terms of Service.

We may update this EULA from time to time. When we make material changes, we will update the "Effective Date" above and, where appropriate, notify you within the App. Your continued use of the App after the changes take effect means you accept the updated EULA. If you do not agree, you must stop using the App.

If any provision of this EULA is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer this EULA without our prior written consent; we may assign it in connection with a merger, acquisition, or sale of assets. Neither party is liable for any delay or failure to perform caused by events beyond its reasonable control.

This EULA constitutes the entire agreement between you and Filin Solutions FZE concerning the App and supersedes all prior or contemporaneous agreements, whether oral or written.
